RE: The tariff classification of two metalized/polyester blend woven fabrics from India and Taiwan.

Dear Ms. Daniels:

In your letter dated April 14, 2005 you requested a tariff classification ruling.

Two samples of woven fabric accompanied your request for a ruling. The first, designated as style FB680 (J3076) “Lame Fabric”, is a satin woven fabric composed of 58% metalized yarns and 42% polyester. The fabric is characterized by a reflective red surface created by the warp face satin yarns made from synthetic strip that has been metalized. The filling is formed from multifilament polyester yarns. Weighing approximately 48 g/m2, this product will be imported in 108 centimeter widths. Your correspondence indicates that this item will be produced in India and will be marketed for use as decorative elements in display cases.

Style Y8Q09794-3 (H30988) “Grosgrain Ribbon” is a plain woven fabric composed of 60% metalized yarns and 40% filament polyester. It is characterized by prominent ribs formed by the warp yarns which are composed of metalized synthetic textile strip. It contains 42 strips per centimeter in the warp and 12 filling picks per centimeter. Weighing 85 g/m2, this product will be imported in 72.5 centimeter widths. Wires have stitched in place along both edges of the fabric to provide this item with added body. Your correspondence indicates that this item will be manufactured in Taiwan and will be used as a decorative element in display cases.

The applicable subheading for the two woven fabrics designated as styles FB680 (J3078) “Lame Fabric” and Y8Q09794-3 (30988) “Grosgrain Ribbon” will be 5809.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of metal thread and woven fabrics of metalized yarn of heading 5605, of a kind used in apparel, as furnishing fabrics or for similar purposes, not elsewhere specified or included. The rate of duty will be 14.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
